South African Cannabis Laws

South African Cannabis Laws

Cannabis is still illegal in South Africa.

It is illegal to have it in your possession or use it without written authorization.

Being arrested with it may result in a fine or a criminal record or both.

On Wednesday the 11 March 2015 the Portfolio Committee on Health was informed on record by the Department of Health that an existing structure is in place for the legal use of Cannabis and Cannabinoidal medicine via a Section 21 Application from a patient motivated by his/her doctor to the Medicines Control Council.

This Section 21 Application process enables the use of an unregistered drug under specific conditions with permission from the Director-General.

You can view the Section 21 application above or simply click here.

Please deal directly with the HPCSA regarding the Section 21 application.
