Daily I receive emails and whatsapps from people across South Africa who are wanting to know how to get a legal licence to grow Cannabis or hemp.
Most of these people are private individuals who are wanting to sell their Cannabis on the open market without fear of prosecution. And then there are international and local companies who are wanting a legal Cannabis permit to cultivate Cannabis or hemp to export to Canada.
Unfortunately, it’s impossible to try and assist everyone who makes contact looking to secure or buy a Cannabis licence in South Africa. The Medicines Control Council (MCC – now known as SAHPRA) has published a list of guidelines for prospective growers of medical cannabis in South Africa.
Applicants will need to show adequate measures to ensure security, transport, destruction, reporting and employment of suitable persons to be considered for a licence, which will be granted if the farmer can also show the ability to adhere to the Good Manufacturing Practice (GMP) for medicines in SA. Anyone with a conviction for an illicit drug-related offence may not apply. This includes anyone ever arrested for being in possession of dagga in South Africa.
There are currently no restrictions on the number of licences that may be issued by the MCC, but the overall quantities of marijuana cannot exceed quotas allocated by the International Narcotics Drug Control Board.
The legislative framework to allow for domestic cultivation of medicinal cannabis is currently under development by the Department of Health in consultation with the MCC. Cannabidiol (CBD) was already rescheduled to a Schedule 4 substance last year which theoretically opens the way for the cultivation of hemp.
The MCC (SAHPRA) have begun with their inspector training and some initial site inspections have been done. To date no official licences to cultivate Cannabis in South Africa have been approved.
